Interpretation and Application of Rules

Where parties have selected rules other than the KCAB Rules and a matter arises that is not covered under such rules, the arbitral tribunal shall have the power and authority to apply the relevant KCAB Rules. If there are no applicable KCAB Rules, then the matter shall be referred to the KCAB for a final decision. The KCABs decision shall, to the greatest extent possible, conform to the intent of the rules selected by the parties.

The arbitral tribunal shall interpret and apply the rules selected by the parties insofar as they relate to the tribunal's powers and duties. Unless the selected rules otherwise provide, whenever the panel consists of more than one member and a difference of opinion arises among such members in regard to the interpretation or application of any such rule, this matter shall be decided by a majority vote. If this is not possible, either a member of the tribunal or a party may refer this issue to the KCAB for a final decision.
