표준중재조항
각국의 상설중재기관에서는 중재의 효율성을 높이고 신속한 중재절차의 진행을 위하여 당사자들이 중재계약을 체결할 때 쉽게 이용할 수 있도록 표준중재조항을 마련해 놓고 있습니다. 계약서에 이러한 표준중재조항을 삽입하시면 중재합의에 관한 다툼없이 중재를 진행하실 수 있습니다. 대한상사중재원에서 권고하는 ‘표준중재조항’은 다음과 같습니다.
1. 일반절차
1) 국내거래
“이 계약으로부터 발생되는 모든 분쟁은 대한상사중재원에서 국내중재규칙에 따라 중재로 해결한다.”
2) 국제거래(국문)
“이 계약으로부터 발생되는 모든 분쟁은 대한상사중재원에서 국제중재규칙에 따라 중재로 해결한다.”

3) 국제거래(영문)

2. 중재인을 당사자가 직접 선정하는 방식
1) 단독중재인의 경우
"이 계약과 관련하여 당사자간에 발생하는 모든 분쟁은 대한민국 서울에서 대한상사중재원의 국내(국제)중재규칙과 대한민국 법에 따라 중재에 의하여 최종적으로 해결한다. 중재판정부는 양당사자들의 합의에 따라 1인으로 구성한다.”
"All disputes which may arise between the parties, in relation to this contract, shall be finally settled by arbitration in Seoul, Korea in accordance with the Domestic(International) Arbitration Rules of the Korean Commercial Arbitration Board and under the Law of Korea. The dispute shall be decided by a sole arbitrator appointed by agreement of both parties."
2) 3인판정부의 경우
"이 계약과 관련하여 당사자간에 발생하는 모든 분쟁은 대한민국 서울에서 대한상사중재원의 국내(국제)중재규칙과 대한민국 법에 따라 중재에 의하여 최종적으로 해결한다. 중재판정부는 3인으로 구성하되 각 당사자는 각자 1인의 중재인을 선정하고, 이에 따라 선정된 2인의 중재인들이 합의하여 의장중재인을 선정한다.”
"All disputes which may arise between the parties, in relation to this contract, shall be finally settled by arbitration in Seoul, Korea in accordance with the Domestic(International) Arbitration Rules of the Korean Commercial Arbitration Board and under the Law of Korea. The arbitral tribunal consists of three arbitrators, each party shall appoint one arbitrator and two arbitrators chosen by them shall appoint a third arbitrator, as a presiding arbitrator.”
3. 신속절차
1) 국내거래
“이 계약으로부터 발생되는 모든 분쟁은 대한상사중재원 국내중재규칙의 신속절차에 따라 중재로 최종 해결한다.”
2) 국제거래
“이 계약과 관련하여 당사자간에 발생하는 모든 분쟁은 대한민국 서울에서 대한상사중재원 국제중재규칙의 신속절차 및 대한민국 법에 따라 중재에 의하여 최종적으로 해결한다.”
“All disputes which may arise between the parties, in relation to this contract, shall be finally settled by arbitration in Seoul, Korea in accordance with the Expedited Procedures in International Arbitration Rules of the Korean Commercial Arbitration Board and under the Law of Korea.”
